Terms & Conditions
*”Media” refers to any/all images, videos, tours or floor plans, design assets or any other intellectual property created by employees of House to Home Photography.
Scope of Work:
House to Home Photography provides professional real estate media services to its clients. The scope of work includes taking photographs, video footage, and/or virtual tours of residential and commercial properties for the purpose of advertising and promoting real estate listings. This includes video editing and virtual tour hosting as part of the services rendered.
Payment:
Clients agree to pay House to Home Photography for its services as outlined in the pricing and payment terms provided by House to Home Photography. Payment is due in full upon receipt of media or as otherwise agreed upon by the parties. Clients may be subject to additional fees. Any cancellations or requests for additional services may incur fees as outlined in the terms of service.
Ownership and Usage Rights:
House to Home Photography retains ownership and copyright of all media. Clients are granted a limited, non-exclusive license to use the photographs, videos, and virtual tours for advertising and promotional purposes related to the specific property. Clients may not use the media for any other purpose without the express written consent of House to Home Photography. Additionally, clients agree to credit House to Home Photography as the photographer/videographer when images or videos are used in social media for purposes unrelated to the specific property listing. This includes situations where the media is used to promote the real estate agent, where House to Home Photography social media accounts (@htohphotos) should be visibly tagged.
Copyright and Intellectual Property:
House to Home Photography retains all intellectual property rights to all media. Clients agree not to use the media in a manner that infringes upon House to Home Photography's intellectual property rights or otherwise violates any applicable laws or regulations. Clients may not alter or modify the media without written consent from House to Home Photography. This includes unsanctioned design changes, such as altering or recoloring images, editing video speed or audio, adding excessive graphics or overlays to media, or juxtaposing our media next to video or images that are objectionable or otherwise unrelated to real estate.
Cancellations:
Cancellations made more than 48 hours before the service appointment will not incur any fees. For cancellations less than 48 hours of the service appointment, a fee of 25% of the order total is applied. Cancellations within 12 hours of booking time/date, a fee of 75% of the order total is applied. All cancellation requests must be made via email to htohphotos@gmail.com.
Delivery and Turnaround Time:
House to Home Photography will deliver the final media to the client within the agreed-upon timeframe. In the event of unforeseen circumstances that may cause a delay in delivery, House to Home Photography will notify the client as soon as possible.
Liability and Indemnification:
House to Home Photography is not responsible for any damage to the property or any personal injury that may occur during the photography session. Clients agree to indemnify and hold House to Home Photography harmless from any and all claims, damages, or expenses arising out of or in connection with the photography session.
Confidentiality:
House to Home Photography agrees to maintain the confidentiality of all client information and will not disclose any client information to any third party without the express written consent of the client.
Termination:
Either party may terminate this agreement at any time with written notice to the other party. In the event of termination, the client will be responsible for any fees owed for services rendered prior to termination.
Governing Law and Jurisdiction:
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario. Any disputes arising out of or in connection with this agreement shall be resolved by the courts of the Province of Ontario.
By using House to Home Photography's services, clients agree to be bound by these terms and conditions. These terms and conditions may be updated from time to time, and clients will be notified of any changes in writing.
